This Privacy Policy describes how OraClaim collects, uses, and protects your Confidential Information in connection with your use of the Service. By using the Service, you expressly consent to OraClaim’s use of your Confidential Information consistent with this Privacy Policy. OraClaim is designed as a closed, access-restricted system for attorneys, claims professionals, and authorized client representatives to collaborate on the defense, evaluation, and resolution of legal claims. The Service is intended to preserve all applicable legal privileges and confidentiality protections to the fullest extent permitted by law.

Definition of Confidential Information

“Confidential Information” includes the following information uploaded or otherwise submitted for processing by the Service: (i) information reasonably considered confidential under the circumstances, including information identified as such at the time of disclosure; (ii) information explicitly identified as confidential; (iii) attorney work product or attorney-client privileged information; (iv) claim-related documents such as pleadings, discovery, medical records, employment records, and financial records; and (v) information identifying, relating to, describing, capable of being associated with or that could be linked, directly or indirectly, with particular persons or households, including but not limited to information derived from such information that is used to create inferences regarding or profiles of such persons or households (“Personal Information”). All Confidential Information shall be deemed disclosed to OraClaim solely in its capacity as an agent and service provider acting on behalf of the Customer, and not as an independent recipient, for purposes of maintaining all applicable privileges and protections.

Information OraClaim Collects

Account Registration Information: When you create an account or register for the Service, OraClaim collects basic Personal Information such as name, email address, phone number (if provided), and company details. This information is necessary to set up your account, provide you with access to the Service, and communicate with you regarding updates and account support.

Confidential Information Storage & Handling: OraClaim may, at Customer’s request, collect, store, and process Confidential Information belonging to Customer and/or Customer’s third-party clients or litigation/dispute resolution adversaries, for purposes of delivering Customer-desired Outputs. All Confidential Information is handled exclusively within a closed, access-restricted environment operated for the benefit of Customer and its authorized users. Any third-party infrastructure or software components utilized by the Service operate solely as sub-processors acting on OraClaim’s behalf, are contractually prohibited from accessing, reviewing, retaining, or using Confidential Information for any purpose other than transient processing necessary to deliver the Service, and do not receive Confidential Information for independent use, training, model improvement, or human review. Such processing is intended to function as an extension of Customer’s own computing environment and is not intended to constitute disclosure to a third party for purposes of attorney-client privilege, work-product doctrine, or any other applicable privilege or protection. While in custody of the Service, all Confidential Information is protected by the data security measures and retention policies outlined below.

Usage Data and Metrics: OraClaim collects anonymized usage data and metrics related to your interactions with the Service, such as user requests, activity logs, feature utilization, and generalized document types. This Aggregated Data is collected for the purpose of improving and optimizing the Service, identifying areas for enhancement, compliance monitoring, and troubleshooting. No Aggregated Data includes Confidential Information.

Platform Health Metrics and Telemetry Data: OraClaim collects basic platform health metrics and telemetry data, which cannot be disabled, to monitor the performance and reliability of the Service, identify potential outages or issues, and ensure reliable service delivery. This data does not include any Confidential Information and is used exclusively for internal monitoring and maintenance purposes.

Use of Artificial Intelligence and Preservation of Legal Privileges

The Service incorporates automated processing technologies, including artificial intelligence and machine-learning components, that operate solely at the direction of authorized users to generate Outputs requested by those users. OraClaim does not act as an independent author, advisor, or decision-maker. OraClaim expressly intends that all Confidential Information processed through the Service, including prompts, inputs, intermediate outputs, and final Outputs, remain subject to all applicable legal privileges and protections, including but not limited to the attorney-client privilege, attorney work-product doctrine, common-interest doctrine, and insurer-insured privilege, to the fullest extent permitted by law. OraClaim does not permit Confidential Information to be used to train, fine-tune, improve, or validate any artificial intelligence or machine-learning models, nor does it permit human review of such information by OraClaim personnel or third parties except as expressly authorized by Customer for support or security purposes and subject to confidentiality obligations consistent with this Privacy Policy. Use of the Service is intended to be functionally equivalent to the use of traditional legal research, drafting, and document-management software operated within a law firm or claims organization, and not a disclosure or publication of Confidential Information to external parties.

Your Right to Access and Correct Personal Information

To the extent we collect your Personal Information, you have the right to reasonably request access to, and the ability to correct such information and OraClaim will exercise commercially reasonable efforts to grant such access provided such information remains within its control.

Data Sharing and Disclosure

OraClaim does not sell, trade, or rent your Confidential Information to third parties for marketing or advertising purposes. For the avoidance of doubt, OraClaim’s use of automated processing technologies, including artificial intelligence and machine-learning components, does not constitute a disclosure or transfer of Confidential Information to third parties for purposes of privilege waiver, confidentiality loss, or adverse use. OraClaim may share limited account identification details with trusted third-party service providers who assist us in operating, maintaining, and providing technical support for the Service solely for the purposes of facilitating service delivery, troubleshooting, and addressing technical issues. These service providers are contractually obligated to maintain the confidentiality and security of the shared information and are prohibited from using your information for any other purpose.

OraClaim may also disclose your Personal Information if required by law, legal process, or in response to valid requests from public authorities, such as court orders or government investigations. In such cases, OraClaim will make reasonable efforts to notify you before disclosing your information, unless prohibited by law or court order.

Data Security

OraClaim is dedicated to maintaining the confidentiality and integrity of Customer data entrusted to our Service offerings. With a commitment to safeguarding your Confidential Information, OraClaim employs industry-standard security measures around encryption, authentication, and data protection. These are designed to shield your data from unauthorized access, misuse, or disclosure. While OraClaim strives to implement commercially viable and advanced security practices, it’s important to understand that no digital platform can offer absolute security. OraClaim continuously works to enhance our security measures in alignment with evolving threats and standards to ensure the highest level of protection for your data. In the event of a security breach, we will notify you within the time period required by applicable law.

Data Retention

OraClaim retains your data only for as long as is necessary to deliver our Service effectively and to fulfill our legal and regulatory responsibilities. This includes adhering to financial, tax, and legal reporting requirements which may necessitate holding onto certain data for specified periods. Upon the termination of your subscription, OraClaim will securely erase your data from our systems within 60 days, except when legally obligated to maintain records or for purposes of commercially reasonable backup and archival procedures.

Third-Party Services

The Service integrates with third-party services and technologies each subject to their own privacy policies and data practices. OraClaim encourages you to review the privacy policies of any third-party services before enabling integrations or sharing data. OraClaim does not exercise control over, nor does it assume responsibility for, the content, security measures, or privacy protocols of any integrated or accessible third-party services or technologies. Engaging with third-party services through our platform is done at your sole discretion and risk.

Changes to this Privacy & Security Policy

OraClaim may update this Privacy Policy from time to time with prior notice. Your continued use of the Service constitutes acceptance of the updated Privacy Policy.
